The Kentucky Indiana Bridges Disadvantaged Business Enterprise Directory (“DBE Directory”) is provided by the Louisville-Southern Indiana Ohio River Bridges Project (“LSIORBP”). As a user of the Kentucky Indiana Bridges Disadvantaged Business Enterprise Directory (“DBE Directory”), you agree to be bound by these Terms & Conditions.
1. When licensing DBE Directory data and/or reports, these products are licensed to you for your internal use only. They may be used by you solely as one factor in your business decisions, and will not be used to determine an individual's eligibility for credit or insurance.
2. The products shall not be reproduced, revealed, or made available in whole or part to anyone else unless required by law. You acknowledge that the products are subject to the copyright and other proprietary rights of LSIORBP and you will not commit or permit any act or omission that would impair such rights.
3. LSIORBP AND ITS STRATEGIC PARTNERS (INCLUDING ITS LICENSORS AND RECEIVABLE MANAGEMENT SERVICES) DO NOT GUARANTEE OR WARRANT THE DBE DIRECTORY INFORMATION/DATA IN ANY WAY. THE DBE INFORMATION/DATA IN THIS DIRECTORY IS PROVIDED BY THE DISADVANTAGED BUSINESS ENETRPRISES (“DBE”) THEMSELVES AND IS NO SUBSTITUTE FOR CONTACTING THE DBE AND VERIFYING THEIR INFORMATION THROUGH DUE DILIGENCE. NEITHER LSIORBP NOR ITS STRATEGIC PARTNERS SHALL BE LIABLE TO YOU FOR ANY LOSS OR INJURY ARISING OUT OF OR CAUSED, IN WHOLE OR IN PART, BY LSIORBP 'S AND/OR ITS STRATEGIC PARTNERS' NEGLIGENT OR OTHER ACTS OR OMISSIONS IN PREPARING OR DELIVERING THE PRODUCTS OR SERVICES OR IN DOING ANYTHING RELATED THERETO. LSIORBP AND ITS STRATEGIC PARTNERS WILL NOT BE LIABLE FOR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
4. IF, NOTWITHSTANDING THE ABOVE, LSIORBP AND/OR ITS STRATEGIC PARTNERS ARE HELD TO BE LIABLE THE AMOUNT OF SUCH LIABILITY SHALL NOT EXCEED $500.
5. All information provided by your or your company representatives during registration or during any subsequent sessions is made free and available to all approved users of the DBE Directory. By providing this information, you approve of its release to parties approved by the LSIORBP and its Strategic Partners.
6. You agree to comply with applicable state, local, federal or foreign laws or regulations, including laws and regulations regarding telemarketing / email / fax marketing, customer solicitation, and privacy regarding the products and the collection, processing or transfer of information or software.
7. This agreement and performance hereunder shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, U.S.A., and any action, suit or proceeding instituted hereunder shall be maintained in the courts of the Commonwealth of Kentucky, U.S.A., or the federal courts located in the Commonwealth of Kentucky, U.S.A., which courts shall have exclusive jurisdiction for such purposes.
8. You may asked to be removed from the DBE Directory at any time by contacting the DBE Program Manager at CTS by calling (502) 394-3840 or emailing us at info@bridgesdbedirectory.com.
9. I acknowledge that this DBE Directory is designed for locating DBEs qualified for work on the LSIORBP, and is not intended to be used by larger organizations as a substitute for traditional risk management and marketing services.
10. These Terms and Conditions may be amended from time to time. Any amendment is effective upon either a posting of the latest version on the applicable LSIORBP web page, or upon notice by electronic mail or US mail. Notwithstanding any opt-in or opt-out preferences you may have expressed, LSIORBP reserves the right to notify you by email of changes to these Terms and Conditions. Your continued use of the licensed products following notice of any amendment to this agreement shall be conclusively deemed an acceptance of such amendment.
